Why do you need estate planning?

Creating an estate plan is the best way to make sure that your wishes regarding your family and your assets are carried out in full.  With a personalized estate plan, you can plan exactly what would happen in the event of an accident that leaves you unable make decisions for yourself, as well as directing how assets should be distributed after your death.

What is the difference between a will and a trust?

The process of creating a will or a trust can be confusing, but our attorneys at Gordon Law Group, PLC are here to help you.  Depending on where you are in your life, and on your family and financial circumstances, we might recommend an estate plan centered around either a will or a trust. 

Essentially, both documents provide instructions for how you want your assets distributed after your death.  A will is instructions to the court, whereas a trust is instructions to whomever you select as trustee. 

A will goes into effect only after you pass away and once it has been presented to the court this is the start of the probate process, discussed below.  Because a trust goes into effect as soon as you have signed the document, in addition to describing how you want your assets distributed after you pass away, it also allows you to control how your assets are handled during your lifetime.  For example, you can outline who would be in control of your accounts and how that person should manage the funds in the event that you become incapacitated and unable to manage your own finances. 

What is probate?

Probate is the legal process of administering the estate of someone who has died.  Typically, if a loved one has written a will, then when he or she dies, that will is presented to the court and probate is opened.  The court names the personal representative of the estate – usually whoever was named as executor in the will, but if there was no will, or if the named executor(s) are not willing or able to serve, then the court will appoint an administrator (usually the next of kin, if willing and able).  The personal representative has the responsibility to oversee the estate throughout the probate process.  This can include identifying and securing assets, paying outstanding bills, and distributing assets to the heirs or beneficiaries.  At Gordon Law Group, PLC, we can help you and your family with all aspects of the probate process.
